COMMENT: 30 Year Failure.

Dear A-Letter Reader:
Regular readers of The A-Letter know that I often have addressed the destruction of personal and financial privacy caused by the 2001 PATRIOT USA Act that was rushed through the US Congress shortly after the 9-11 terror attacks. The 342 page law gave the FBI and police many unchecked powers, including broad surveillance over domestic and offshore financial activity.

The justification for this unprecedented grant of police power over US citizens was to prevent future terror attacks. The big lie used to extend control over personal financial information was that this would allow government to find unusual patterns of financial activity terrorist use.

At the same time proponents argued this would curb money laundering.

But there is a real question whether any of these specious arguments are true. And there is a 30-year old US federal law that proves just how costly and ineffective this sledgehammer approach is.

Writing in the November issue of Reason magazine (see LINK below) John Berlau recounts in detail the history of the Bank Secrecy Act of 1970. In many ways the BSA was an earlier version of the PATRIOT Act. It all but repealed 4th Amendment protections against unreasonable searches and seizures so far as bank records were concerned.

Aside from the supposed curbing of criminal financial activity, how has the BSA operated on a practical level? It has required massive paperwork.

Even before the PATRIOT Act, under the BSA banks sent more than 12 million transaction reports to the government in 2000 alone. One expert estimates that banks file more than 100,000 reports on innocent customers for every money laundering conviction. Review of these millions of reports are now backed up for over two years.

It is estimated that US$856.6 billion was laundered world wide in 2002. The total will grow at an annual rate of 2.7% to reach US$926.6 billion by 2006. Large institutions will spend a total of US$845 million and mid-tier firms a total of US$2.2 billion on anti-ML programs up to 2005. Small sized financial institutions will spend an aggregate of US$7.9 billion. You pay the bill for all this in increased fees.

Meanwhile the government is using its so-called "anti-terror" and "anti-money laundering" laws to chase tax evasion and a host of other alleged crimes, all without the normal legal rights and safeguards that were supposed to be guaranteed by American law.

Does anybody care?
